REQUEST FOR TENDER ''Nationwide Health Care in Danger Campaign in 2021''

OBJECT

Within the framework of its assistance program for Lebanon, the ICRC intends to have the below mentioned Service and is hereby requesting an Offer/Proposal from your company to conduct a nationwide campaign in Lebanon, as detailed in the attached TOR (Annex ≠ 1) and Brief (Annex ≠ 2).

A brief session will be held by ICRC communication department on Thursday and Friday the 4th and 5th of March respectively at 11:30hrs, at ICRC Offices in Mansour Building, Sadat Street, Hamra, Beirut, Lebanon or by skype. Please Confirm your attendance by E-mail to : [email protected].

PRICE AND PAYMENT

The Financial offer/proposal should be in USD / LBP and exclusive of the VAT; the VAT amount shall be indicated separately (if applicable).

The Financial Proposal shall be prepared list all major cost components associated with the services, and the detailed breakdown of such costs.

All outputs and activities described in the Technical Proposal must be priced separately on a one-to-one correspondence. Any output and activities described in the Technical Proposal but not priced in the Financial Proposal, shall be assumed to be included in the prices of other activities or items, as well as in the final total price.

Transportation, accommodation costs should be included in the fixed fee (if required).

Prices offered should not be linked with any variant. Offers linked with variants will be rejected.

Payment terms

The payment of the fees will be done by bank transfer within 30 banking days after reception and acceptance of all goods/Services against Original invoice.

 

DELIVERABLES

Offers/Proposals to be submitted shall consist of 2 (two) parts, one for the concept alone and another one combining concept and production. Each part should be divided into 2 (two) parts financial and technical to be submitted separately:

Part I: Technical offer - shall contain:

A detailed “Method Statement” including all the procedures. Also, the method statement must describe every task and its correlation with any other relevant job.

A detailed schedule “Time Table” in relation to the method statement indicating the time necessary to mobilize, to implement the work.

Part II: Financial offer - shall contain:

A detailed “Cost Breakdown”.

A proposed “Schedule of Payment”.

 

PENALTY CLAUSE

Failure by Seller to avail the full service by the agreed date will result in the Seller being penalized with a 1% reduction of the value of the undelivered goods per day of delay up to a maximum of 10 % of the total value of the contract.

After 10 days of delay, ICRC reserves the right for partial or total cancelation of the order.

 

PLEDGE OF DISCRETION / ICRC NAME AND LOGO

The objective of the ICRC is to provide protection and assistance for victims of war, civil war or internal disturbances and for other victims on whose behalf the ICRC is called upon to take action. To attain this objective as effectively as possible, the ICRC must at all times enjoy the confidence of governments and of the victims.

This confidence is largely based on the neutrality of the ICRC and on the discretion with which it conducts its activities and, in particular, on its undertaking that anybody active for the ICRC will never disclose what he sees or learns while working for the ICRC.

Accordingly, anybody active for the ICRC therefore undertakes to observe the utmost discretion concerning matters with which he shall be called upon to deal or which may come to his knowledge and to consider himself bound by professional secrecy in this regard. This duty shall remain in effect even after the contract has ended.

 

NON-DISCLOSURE AND CONFIDENTIALITY

Bidders must treat the Invitation to Tender, contract and all associated documentation (including the Specification) and any other information relating to ICRC’s employees, servants, officers, partners or its business or affairs (the "Confidential Information”) as confidential. All Bidders shall:

Recognize the confidential nature of the Confidential Information;

Respect the confidence placed in the Bidder by ICRC by maintaining the secrecy of the Confidential Information;

Not employ any part of the Confidential Information without ICRC's prior written consent, for any purpose except that of tendering for business from ICRC;

Not disclose the Confidential Information to third parties without ICRC's prior written consent;

Not employ their knowledge of the Confidential Information in any way that would be detrimental or harmful to ICRC;

Use all reasonable efforts to prevent the disclosure of the Confidential Information to third parties;

Notify ICRC immediately of any possible breach of the provisions of this Condition and acknowledge that damages may not be an adequate remedy for such a breach.

 

COPYRIGHT

The Assignee herewith automatically cedes to the ICRC all transferable rights to the use, publication or distribution of any material prepared for or on behalf of the ICRC, including the right to transfer these rights to third parties, free of charge or against payment.

 

QUALITY INSPECTION AND ACCEPTANCE

This contract is subject to quality acceptance by the Buyer himself. The Seller will give all necessary assistance.

The Seller will be responsible for the service quality delivered according to the agreed specification. In case of delivery of non-conforming services, the Buyer has the right to reject services not meeting the specifications stipulated in the contract.

In this case, the buyer may cancel the contract or request replacement of the services. In both cases the Seller is liable for any costs of replacement, transportation, taxes and charges and any other costs that may occur.

 

TERMINATION

Either party may terminate this contract in writing at any time.

Except when the termination is for breach of contract, the work completed shall be paid pro rata temporis and no other consideration shall be due. The Consultant shall deliver the work to the ICRC with a comprehensive, usable summary of performance to date and any conclusions drawn from it.

 

APPLICABLE LAW

Swiss law governs this contract, the clause of arbitration if any, and the arbitration procedure exclusively without regard to conflicts principles.

 

ARBITRATION

This contract is subject to arbitration exclusively, according to the attached General Conditions (Annex ≠ 3) .

 

GENERAL CONDITIONS

All conditions not mentioned herein shall be governed by the ICRC General conditions on purchasing.

Acceptance of the contract entails the waiving by the Seller of its General Conditions of Sales.

The ICRC reserves the right to split the commodity into separate Purchase Orders with different Sellers. ICRC is not liable to provide any explanation for its final selection of the Seller. It has to be noted that this Tender does not imply any commission. Any offered commission will lead to the Seller's suspension.

 

Important Notes:

Emails should be maximum size of 4.8MB, otherwise the system will not receive it.

Each of the financial and technical offer should be submitted each in a separate Email.

It has to be noted that this Tender does not imply any commission and that ICRC is not liable to provide any explanation for its final selection.
 
All offers received will be held in confidence.
All offers submitted after the specified closing date are ineligible.
All offers not following the clause for Deposit of offers will be disqualified.
Offer changes by Seller must be received in writing prior to the closing date and must indicate that it is a revised quotation.
All participating Sellers will be notified of the result of the selection process as soon as it is concluded.
