Legal and Financial Compliance Specialist

Kvinna till Kvinna’s Syria Regional Programme focuses on women´s increased participation, psychosocial support, and women´s economic empowerment as well as support to partner organisations’ capacity building, networking and advocacy in the region.

Purpose of the assignment

One of Kvinna till Kvinna partner organizations is based in Germany and has recently opened a branch in Iraq's Kurdistan-Erbil region to support the implementation of the organization’s programmes and activities. To ensure the smooth operation of the branch’s activities, our partner’s management wishes to receive a better understanding of working in different regulations, particularly about legal matters related to overseas recruitment processes, as well as an adequate understanding of tax regulation on branch management in countries outside the European Union. The organization would further like to understand how to integrate financial and accounting systems to comply with legal requirements and international accounting standards.

To support our partner organization, Kvinna till Kvinna is seeking a legal and financial compliance specialist with extensive experience in interpreting and applying regulatory and legal requirements in accordance with German laws in diverse regions. As a highly technical consultancy position, the successful candidate will support our partner’s management in ensuring the organization’s compliance with the legal and tax requirements in Germany by providing’ gap assessments in terms of complying with best practices, developing action plans, and supporting management with the implementation of the action plans produced. The successful candidate will further provide advice on good corporate governance for programs implemented by other personnel in the field.

 

Details of the assignment Deliverables

 

  • Work with the partner organization to provide an assessment of the current organizational situation through which it operates.
  • Present a plan for organizational development with action plans and follow-up with management on the implementation of the action plan.
  • Develop a Subgrating policy that mainly includes the financial and accounting procedures to be followed to ensure compliance with local and international standards.

 

 

 

Deliverables and reporting requirements

 

Inception

  • Submit an inception report (around 1-2 pages) explaining how the consultant envisions the process of the assignment and a detailed work plan, including tentative timing.

 

Implementation

  • Review and assess existing relevant policies, procedures, tools, and related documents of the partner organization;
  • Develop tailored organizational development plan with action plans and a Subgrating policy;
  • Follow-up with key staff and management in the partner organisation to discuss and finalize the new policies and plans;
  • Prepare and conduct meeting for the partner organization to discuss with relevant staff on how to implement the developed policies and plans;
  • Present to and discuss with management of the partners organizations before finalizing the documents; and
  • Submit the final version of the policies and plans.

 

 

Final reporting:

  • A final report (format can be discussed) that includes summaries of overall findings, observations, and recommendations for the partner organisation to be shared with Kvinna till Kvinna.

 

 

Management and organisation

The consultant will be working closely with the Kvinna till Kvinna Syria Regional Programme team. The consultant is responsible for completing and delivering the above specified deliverables to the Syria Regional Programme team and the partner organization.

 

The total duration of the consultancy is to be decided between the consultant, the partner organization, and Kvinna till Kvinna’s Syria Regional Programme team, based on a time frame submitted by the consultant in accordance with the points specified in this ToR.

 

Consultant fees shall be specified as fees per day including taxes, social security contributions and VAT. The tender shall state an estimated total value of tender, including expenses such as telephone, internet or postage, and expenses for travel to the Middle East and/or Europe related to the assignment.

 

Contracted consultant cannot further subcontract the assignment. In cases where the tender includes a team of consultants, their division of work shall be presented.

 

 

Required qualifications

  • Master’s degree in Law, Finance, International Development, or any relevant field, combined with at least 10 years of relevant professional experience.
  • Familiarity with NGO practices, international standards and trends on compliance including partners in various countries.
  • Demonstrated knowledge and understanding of financial regulatory environments in low- and middle-income country contexts, preferably Middle East countries.
  • Demonstrated ability to provide clear and concise written guidance on complex financial issues to grantees, branches, and other entities out of the EU.
  • Demonstrated ability to produce and deliver financial management related training.
  • Ability to demonstrate interpersonal skills as the position requires communicating and working effectively with people from diverse cultures and ethnicities.
  • Demonstrated understanding of tax, legal codes and accounting systems related to working in many countries.
  • Excellent written and verbal communications skills in English.
