Formal Informality, Brokering Mechanisms, And Illegality: The Impact Of Lebanese State’S Policies Targeting Syrians On Everyday Life.

While Lebanese State policies and measures launched in October 2014 have been initially designed to formalise the presence and control the influx of syrian refugees in Lebanon, these regulations have, in practice, led to a set of incoherent procedures when it comes to obtaining and renewing residencies and/or work permits.
This has contributed to further distancing between Lebanese state institutions and refugees. This was intensified by the unclear, supposedly mediating, role of international organizations, as well as the emergence of informal blackmailing/broker institutions mediating between refugees and state institutions. The highly formalised process was therefore quickly undermined by informal processes and mechanisms which increased insecurity and precariousness for Syrian refugees.
This causes a high, and until now rather understudied, rate of illegality.
Our endeavour in this discussion is to explore the impacts of these measures on legal/ illegal statutes, the lack of protection, notably affecting families and children’s everyday life. Consequences of these policies – ranging from limited freedom of movement and action to exploitative structures in relation to housing/work, to cases of trafficking and forced sex work – often make it difficult to access basic services and state provision such as hospitalisation, schooling, etc.

في حين أن السياسات والتدابير التي اعتمدتها الدولة اللبنانية في تشرين الأول/أكتوبر صُمِّمت أصلا من أجل تنظيم وجود اللاجئين السوريين في لبنان، وضبط تدفقهم، إلا أن هذه التنظيمات أدت في الواقع إلى بروز مجموعة من الإجراءات والمعايير الجديدة غير المتجانسة للحصول على تصريحات الإقامة وتجديدها، و/أو إجازات العمل.
وقد ساهم ذلك في تعميق بشكل أكبر الشرخ بين مؤسسات الدولة اللبنانية واللاجئين. وما فاقم الأمور هو الدور غير الواضح الذي تؤديه المنظمات الدولية، بينما يُفترض بها القيام بدور الوسيط، كما نشوء مؤسسات سمسرة/ابتزاز غير رسمية تقوم بالوساطة بين مؤسسات الدولة واللاجئين. وعليه، سرعان ما أدت الآليات والعمليات غير النظامية إلى تقويض الإجراءات البالغة النظامية المعتمدة حديثا؛ ما زاد بدوره من افتقار اللاجئين السوريين إلى الأمان، ومن هشاشة وضعهم. وقد أدى هذا الواقع إلى تسجيل نسب عالية من الاوضاع غير القانونية في صفوف اللاجئين السوريين، وهي نسب لا تزال حتى الآن مُقصاة  نوعا ما عن الدراسات والبحوث قيد الإنجاز.
وفي إطار هذه المناقشة، سنسعى إلى دراسة الآثار الناجمة عن هذه الإجراءات على الأوضاع القانونية/غير القانونية، وغياب الحماية، لا سيما تلك التي تؤثر على حياة الأسر والأطفال اليومية. وغالبا ما تزيد النتائج المتأتية عن هذه السياسات- من تقييد حرية التنقل والحركة، إلى التدابير الإستغلالية في مجال السكن/العمل، وحالات الإتجار، والعمل القسري في الجنس-من صعوبة الوصول إلى الخدمات الاساسية، وتوفير الدولة للخدمات كالإستشفاء، والتعليم...الخ
