Legal Consultant- Short Term Consultancy

Project Background

The USAID-funded Lebanon Trade and Investment Facilitation (TIF) project’s goal is to facilitate exports of Lebanese goods and services and investments that simultaneously promote job creation, income generation, and improved livelihoods throughout the country.

TIF has three objectives:

1) Increased exports of Lebanese goods and services

2) Investment facilitation leading to increased domestic investment, and

3) Improved business and investment enabling environment.

These objectives cover four selected sectors:

1) Agro-Food Processing

2) Manufacturing

3) Knowledge Economy and Services

4) Tourism and Hospitality

Under its Objective 3, TIF  is seeking to hire the services of a Legal Consultant to support in drafting needed laws, decrees or any other regulatory legal documents to serve the business and investment enabling environment (together referred to as “Regulations”).

Tasks

The tasks of the Legal Consultant will be undertaken under the supervision of TIF BIEE Lead.

• Draft or amend specific Regulations identified by TIF.
• Conduct comprehensive research and identify the needed new or modified Regulations regarding specific reform objectives.
• Provide legal advice on the correct procedures throughout the legislative and regulatory drafting process .
• Advise TIF and its partners on matters related to Regulations and legal procedures and help their positioning on matters related to the legal and regulatory framework.
• Provide tools to measure and asses progress in the drafting of the identified Regulations throughout the duration of the assignment.
• Identify and meet with relevant key persons to contribute to the overall assignment and solicit their feedback for validation as needed. This may include facilitating discussions during specific workshops (i.e. roundtables, focus groups or others).
• Actively and effectively communicate with members of parliament, ministers, parliamentary staff, and others as needed to ensure the efficient drafting of the drafted laws.
• Report on progress related to the overall assignement.  
• Other related tasks as needed.

Location of Assignment

The STTA may work remotely (but in Lebanon) with periodical meetings held with TIF BIEE team at TIF’s office in Sin El Fil.  Local travel across Lebanon for certain tasks may be required.

Level of Effort and Period of Performance

The period of performance is expected to extend from May 2023 to August 2023 with possibility for renewal. The Legal Consultant will resume a total of 40 days during the period of this assignment.  

Deliverables

The list below is illustrative and non-exhaustive. The deliverables are relevant to the period of performance. More deliverables may be requested throughout this period:

• Weekly update on progress of research and tasks related to the overall assignment.
• List of potential stakeholders to meet or engage with throughout the period of the assignment.
• Brief meeting minutes held with a specific stakeholder(s).
• A list of suggested laws that need revision, or drafting in line with BIEE priorities.
• Final versions of needed laws and/or decrees or any other legal document.

Reporting and Supervision

The Legal Consultant will work closely with the BIEE Lead to implement each task. To accomplish these tasks, coordination with TIF must be maintained throughout the whole period of execution.  

Qualifications

• Bachelor’s or MS degree in law.
• A licensed professional with at least 20 years of experience in practicing legal services.
• Previous experience in drafting laws, decrees and other relevant legislative documents.
• Extensive knowledge of the Lebanese context explicitly its political and economic axes and connections with multi key stakeholders relevant to TIF’s sectors and field of operations.
• Strong communication skills – both written and oral – in English and Arabic.
